With these UNOX warranty conditions (hereinafter: "Conditions"), UNOX S.p.A. (hereinafter referred to as "UNOX") grants to the End Buyer, in addition to the legal warranty, the possibility to activate free of charge an additional warranty under the following terms and conditions (hereinafter: "Additional Warranty").
1. In these Conditions, the following terms capitalized shall have the meanings ascribed to them herein:
-"End Buyer": the final purchaser of one or more products purchased from an UNOX Dealer;
-"UNOX Dealer": the retailer or sales partner of UNOX from whom the End Buyer purchased the Product;
-“Digital-ID™ Premium Account”: activatable for SPEED-X™, CHEFTOP-X™, and BAKERTOP-X™ ovens via the dedicated application, indicates a set of advanced digital services provided for a fee by UNOX.
-"UNOX Service Partner": the UNOX partner providing technical support services aimed at eliminating the causes of breakdowns or malfunctions and ensuring proper operation.
-"Products": UNOX S.p.A.'s SPEED-X™, CHEFTOP-X™, and BAKERTOP-X™ products.
2. To benefit from the Additional Warranty, it is necessary to register for this purpose on the website www.unox.com within 30 days from the date indicated on the sales invoice by the Dealer to the End Buyer or from the date of installation of the Product at the End Buyer's premises, only if documentation attesting to such installation date is provided and if UNOX, at its discretion, deems it valid.
3. The effectiveness of the Additional Warranty starts from the date indicated on the sales invoice of the Product by the Dealer to the End Buyer or, if earlier, from the day of installation of the Product at the End Buyer's premises. The End Buyer must provide documentation attesting to the start date, and if UNOX, at its discretion, deems it invalid, the start date will be the date indicated on the sales invoice by UNOX to the Dealer.
4. In case of activation by the End Buyer of the extended LONG.Life5 Limited Warranty, the same applies, for SPEED-X™, CHEFTOP-X™, and BAKERTOP-X™ ovens only, if: (i) the Product has been previously connected to the Internet and the constant maintenance of the connection itself to allow UNOX access to data regarding its operating status; (ii) prior subscription to the Digital-ID Premium Account subscription service and monthly payment of the relevant fee and regular payment of all fees for the duration of the LONG.Life5 Limited Warranty validity; (iii) the respective oven has not been modified by the Dealer or by third parties other than UNOX authorized service personnel and has been installed and used appropriately as described in UNOX's technical specifications and instruction manual;
the validity period of this Additional Warranty shall have the following duration:
(i) 24 months or 12,000 hours of operation or 2,000 (two thousand) hours of Magnetron operation, whichever of these three terms expires first, on the labor hours required to perform the activities referred to in point 6; it is understood that such labor will be borne by the UNOX Dealer.
(ii) 60 months or 12,000 hours of operation or 2,000 (two thousand) hours of Magnetron operation, whichever of these three terms expires first, on the spare parts necessary to perform the activities referred to in point 6.
5. In order to benefit from the Additional Warranty, the End Buyer must provide evidence to the UNOX service assistance partner of the UNOX Dealer's name, installation date and place, and the Product model through written confirmation or an installation invoice issued by the UNOX Dealer.
6. During the term of the Additional Warranty, UNOX remedies malfunctions and faults that can be proven to be related to material or manufacturing defects. At UNOX's discretion, UNOX may decide to repair the Product, replace defective parts, or replace the Product.
7. The performance of any service covered by the Additional Warranty during its term neither extends its duration nor renews it.
8. In case of replacement of the Product or its parts, the replaced Product or parts become the property of UNOX.
9. For all interventions carried out by UNOX during the term of the Additional Warranty, the expenses and risks of transporting the Product or its parts are borne by the End Buyer.
10. The End Buyer must notify UNOX or the UNOX service assistance partner in writing of any defects in the Product within 5 working days of discovery. The date of receipt of the notification by the UNOX service assistance partner or UNOX itself shall be deemed authentic.
11. The Additional Warranty does not apply:
- in the event of defects in the Product arising from imperfect installation, as well as defects resulting from repair attempts carried out by unauthorized personnel or not in compliance with the provisions, interventions by unauthorized third parties, non-compliant or improper use, or failure to follow the instructions for use;
- if the instructions in the installation or user manual are not followed, the prescribed maintenance and inspection cycles are not observed, or if detergents and treatments not expressly authorized by UNOX are used. The same applies to defects attributable to the operating environment, such as the use of water not compliant with the specifications stated in the installation and user manual, poor-quality gas, or inadequate power or voltage. Any damage due to overvoltage is excluded from the warranty;
- to consumable and wear parts, such as bulbs, gaskets, etc., as well as damages to glass are excluded from the Additional Warranty;
- in case of damages and malfunctions resulting from limescale deposits on the appliance;
- in case of use of automatic oven cleaning products other than those officially provided by UNOX (UNOX.Det&Rinse);
- to natural wear and tear of the Product;
- if non-original UNOX spare parts or wear parts are used, regardless of whether defects or damages can be attributed to this;
- if the Product has not been used in accordance with the technical provisions of the country in which it is installed.
12. This Additional Warranty is valid exclusively for Products purchased in Italy.
Pursuant to articles 1341-1342 of the Italian Civil Code, the End Buyer declares to have read and specifically accepted the provisions of the following articles of this Additional Warranty:
- article 2 (deadline for registration);
- article 6 (terms and conditions of the Additional Warranty);
- article 8 (ownership of the replaced Product);
- article 9 (transportation expenses and risks);
- article 10 (deadline for defect notification);
- article 11 (limits to the Additional Warranty).
13. EXCEPT WHERE THIS EXCLUSION OR RESTRICTION OF LIABILITY WOULD BE VOID OR INEFFECTIVE UNDER APPLICABLE LAW, IN NO EVENT SHALL UNOX BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOSS OF DATA, LOSS OF REVENUE, FAILURE TO REALIZE SAVINGS OR OTHER BENEFITS, LOSS OF OPPORTUNITY, LOSS OF GOODWILL, OR LOSS OF REPUTATION (SUCH LOSSES, COLLECTIVELY, “LOST PROFITS”)), WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY, EVEN IF END USER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL UNOX’S LIABILITY UNDER THE TERMS SET FORTH HEREIN EXCEED THE AMOUNT PAID BY END USER FOR THE PRODUCTS GIVING RISE TO THE CLAIM. NOTWITHSTANDING ANYTHING TO THE CONTRARY SET FORTH HEREIN, IN THE CASE WHERE NO AMOUNT WAS PAID, UNOX SHALL HAVE NO LIABILITY FOR ANY DAMAGES WHATSOEVER.
